Unfortunately, you may have a 2nd generation. It doesn't go any higher than iOS 4.2 something. Can you look in the Settings - General - About and get the Model Number there?

My son's old one (2nd gen) was an 8 GB Model A1288
Under Settings, it specifies as model MB528LL - iOS 4.2.1 (8C148)

Models numbers are on the back, but they are so small that I can't read them & couldn't find a magnifying glass. My daughter had to come look at it for me.

It looks like quite a number of refurbished models were falsely marketed as newer ones.

Apparently many people who had these w/o realizing they weren't true 3rd gen keep trying to unload them- who knows which sellers know it, and which are going by web searches.
